Ricardo Tosto, a prominent litigation specialist from Brazil, explained the salient features of Brazilian law relating to the foreigners living in the country. According to him, the constitution of the country considers everyone equal before the law. Interestingly, it offers equal rights in terms of liberty, life, equality, property, and security to both Brazilians and the foreigners who are living in the country. Additionally, the foreigners cannot be extradited for any ideological or political offense. However, Ricardo Tosto confirms that the Federal Supreme Court of Brazil can hear the extradition requests from any foreign countries, and the court serves as the original jurisdiction for such requests. He further continues that as per the Article 1, foreign states cannot ask for an extradition if the person is a Brazilian citizen and learn more about Ricardo.
Also, the foreign states cannot get extradition of a person if the case involves Brazilians. However, if the concerning act was performed before making the nationality request, the court is allowed to accept the extradition request. Ricardo Tosto further confirms that upon the extradition request granted, the Department of Federal Police, based on the decision of the Ministry of Justice, arrests the particular person and delivers him to the State for which the extradition allowed. Tosto stated that the provision to not to grant extradition of nationals is also present in a number of countries apart from Brazil. It includes Portugal, Angola, Croatia, Azerbaijan, Guinea Bissau, Iraq, Mozambique, Kazakhstan, Ukraine, São Tomé e Príncipe, and Yemen and more information click here.
